Agreement
By signing up for the Portrait for Me – Hand-Made Oil Paintings from Photos Affiliate Program (“Program”), you agree to be bound by the following terms and conditions (“Terms of Service”).
Portrait for Me – Hand-Made Oil Paintings from Photos reserves the right to update and change these Terms of Service at any time, without notice. Any new features added to the Program, such as new tools or resources, will be subject to these Terms. Continued use of the Program constitutes your acceptance of these changes.
Violation of these terms will result in the termination of your account and forfeiture of any outstanding affiliate commissions. You agree to use the Affiliate Program at your own risk.
Account Terms
- You must be 18 years or older to participate in this Program.
- You must reside in the United States to be an Affiliate.
- Only human users are permitted—accounts registered by bots or automated methods are not allowed.
- You must provide your legal full name, a valid email address, and any other requested information to complete the signup process.
- Your account login may only be used by one person. Sharing a login is prohibited.
- You are responsible for maintaining the security of your account and password. Portrait for Me – Hand-Made Oil Paintings from Photos will not be held liable for any loss or damage resulting from your failure to do so.
- You are responsible for all content posted and activity under your account.
- One person or legal entity may not maintain more than one account.
- The Affiliate Program may not be used for illegal or unauthorized purposes, and you must comply with all laws, including copyright laws.
- You may not use the Program to earn money on your own Portrait for Me – Hand-Made Oil Paintings from Photos product accounts.
Links/Graphics on Your Site, Emails, or Communications
Once you sign up for the Program, you will receive a unique Affiliate Code. You are allowed to place links, banners, or other graphics with your Affiliate Code on your site, in emails, or other communications. Portrait for Me – Hand-Made Oil Paintings from Photos will provide guidelines, link styles, and graphics for you to use.
To ensure accurate tracking, reporting, and referral fee accrual, all links must use special formats provided by us. These links are referred to as “Special Links.” Referral fees are earned only for sales made through Special Links. We are not liable for missed commissions if the links are not properly used.
Affiliate links should direct customers to the product page being promoted.
Referral Fees/Commissions and Payment
To earn a referral fee, the customer must click a Special Link and complete an order during that session. Only sales tracked by our system through properly formatted Special Links are eligible for commission.
Commissions will only be paid after you’ve earned more than $20. If your affiliate account does not meet this threshold, commissions will not be paid. Payments will be made monthly if your earnings exceed $20; otherwise, payments will be made in the following month.
Identifying Yourself as an Affiliate
You may not issue press releases or misrepresent your relationship with Portrait for Me – Hand-Made Oil Paintings from Photos. You cannot claim that we endorse or sponsor you, nor can you imply any false relationship or affiliation.
Purchasing products through your affiliate links for personal use is prohibited and may result in withheld commissions or termination from the Program.
Customer Definition
Customers who purchase through the Affiliate Program are considered our customers. We determine product prices, availability, and policies. Do not display product prices on your site, as they may change. We will do our best to ensure accurate information but cannot guarantee product availability or pricing.
Your Responsibilities
You are responsible for the development, operation, and maintenance of your site, including:
- Technical operation of your site and all related equipment.
- Ensuring compliance with any agreements between you and third parties.
- Ensuring the accuracy and legality of all content on your site.
- Ensuring that your site does not infringe on any third-party rights (e.g., copyrights, trademarks, privacy).
- Disclosing how you collect and use data, including third-party advertising and cookies.
Compliance with Laws
You agree to comply with all applicable laws, including marketing email laws such as the CAN-SPAM Act of 2003, while participating in the Program.
Term of the Agreement and Program
The term of this Agreement begins upon acceptance of your Program application and continues until terminated by either party. Either party may terminate this Agreement at any time by providing written notice. Upon termination, you must cease using our links, trademarks, logos, and any other materials associated with the Program.
Termination
Portrait for Me – Hand-Made Oil Paintings from Photos reserves the right to suspend or terminate your account and refuse service for any reason, including fraudulent or unethical marketing practices. Upon termination, you will forfeit any unpaid commissions.
Relationship of Parties
You and Portrait for Me – Hand-Made Oil Paintings from Photos are independent contractors. This Agreement does not create a partnership, joint venture, or employment relationship between the parties.
Limitations of Liability
Portrait for Me – Hand-Made Oil Paintings from Photos is not liable for indirect, special, or consequential damages, or any loss of revenue or data. Our total liability will not exceed the total referral fees paid to you under this Agreement.
Disclaimers
We make no warranties about the Program or the products sold through it, including warranties of fitness or merchantability. We also do not guarantee that the Program will operate without interruptions or errors.
Independent Investigation
You acknowledge that you have read this Agreement, understand its terms, and have independently evaluated the Program’s desirability. You are not relying on any representation other than what is explicitly stated in this Agreement.
Arbitration
Any disputes relating to this Agreement will be settled through confidential arbitration, except in cases of intellectual property violations, where we may seek injunctive relief. Arbitration will be conducted according to the rules of the American Arbitration Association.
Miscellaneous
This Agreement is governed by U.S. law. You may not assign this Agreement without our prior written consent. Failure to enforce any provision of this Agreement will not waive our right to enforce it in the future. This Agreement constitutes the entire understanding between you and Portrait for Me – Hand-Made Oil Paintings from Photos.
